Artificial intelligence has permeated and altered virtually every industry, and the law is not immune. While most industry discussion focuses on how attorneys themselves are utilizing the new technology (drafting briefs, researching, etc.), our law firm, where we focus on plaintiff-side litigation, is taking note of how AI is shaping the law itself and posing unique challenges in our specific practice areas of employment law, sexual assault law, and sexual harassment law. How AI Supercharges Sexual Harassment From Dominique Strauss-Kahn to Diddy, some of our firm’s highest profile cases center on sexual harassment, which, defined by the Equal Employment Opportunity Commission (EEOC), is a form of discrimination – a pervasive form. And the advancement and proliferation of AI have both enabled and amplified this type of discrimination. While AI tools were previously expensive and required a level of technical expertise, such barriers to access have been removed and even those with a limited skill set are now able to create shockingly realistic content, known as deepfakes. It is a scary time when the process of harassing a target with deepfake pornography, for example, has been drastically simplified. Sexual harassment is one of the most common issues in the workplace, where deepfakes and voice AI may be used as a method of impersonating coworkers, executives, or even students – and, yes, even impersonating offensive conduct is discriminatory. Furthermore, this explicit and damaging content can now be distributed rapidly online with AI-fueled automated harassment via bots. While there is always a person behind these applications, they can now mimic human behavior on a larger scale. Through bots, an abuser can issue a constant stream of inappropriate sexual behavior with no regard for personal boundaries or consent. The result of this accelerated dissemination results in near-immediate damage to the victims’ mental health, reputation, and potentially even to their physical safety. “Tech-enabled sexual abuse is the next frontier in the fight against sexual violence,” said RAINN Founder and President Scott Berkowitz. “I haven’t seen any form of abuse grow this quickly in RAINN’s 31 years.”There are now more opportunities for sexual assault matters to come across our desks.
