Ward County feedlot owner accuses county of violating his due process ...

WARD COUNTY, N.D. (KMOT) – The owner of a feedlot near Surrey, at the center of an ongoing legal battle over the discovery of hundreds of dead animals, has filed a civil suit against Ward County. In March, Your News Leader reported the feedlot operated by Nathan Smith came under investigation following a concern from a former employee about the disposal of scores of cattle carcasses.County deputies located and removed 479 carcasses, and prosecutors later cited Smith for each head of cattle for improper disposal. In a civil complaint filed this month, Smith says the county violated his Fifth Amendment right to due process by not giving him the chance to address disposal issues and removal of the animal carcasses.Smith said he received an invoice for disposal costs from County Auditor/Treasurer Marisa Haman, approved by the County Commissioners, totaling just over $15,700, which he argues does match the number of infractions issued by prosecutors. In the complaint, Smith contends he and the county have adverse legal interests, and he seeks a hold on the requirement of any payments until the ongoing case is resolved. We reached out to Haman and County Commission Chair John Fjeldahl, but neither could comment. This week, we reported that prosecutors filed felony charges of tampering with witnesses against Nathan and Hannah Smith. It’s unclear whether the charges are tied to the investigation into the dead cattle found in the feedlot, as the affidavits are not public record yet.Future court hearings have yet to be scheduled in any of the cases.Copyright 2026 KFYR.
